    I'd sue both granny and the guy who gutted the house and threw out all the stuff that he knew wasn't his because he didn't legally own the house. What a mess. So sorry you're going through this.

    In Alabama the max small claims is 6,000 so what I would do is file the claim for $5,500 they're most likely only going to honor the 4,000 if that's the only one you have a written agreement for but it doesn't hurt to ask. And it cost the same court fee to ask for $5,500 as it does for $4,000. You’re also going to have to pay in the state of Alabama a process server to serve the person if it needs to be done after normal business hours. And this can cost you upwards of $150 to $200 and the court will only reimburse you for $75 just an FYI that’s what I found out when I did a small claims court case in Tuscaloosa county.
