    If anything the judge would have to say 1/3 of the home is your dad's so your husband would only get 1/3 of the money. See if you can buy him out in installments

    In Alabama the max small claims is 6,000 so what I would do is file the claim for $5,500 they're most likely only going to honor the 4,000 if that's the only one you have a written agreement for but it doesn't hurt to ask. And it cost the same court fee to ask for $5,500 as it does for $4,000. You’re also going to have to pay in the state of Alabama a process server to serve the person if it needs to be done after normal business hours. And this can cost you upwards of $150 to $200 and the court will only reimburse you for $75 just an FYI that’s what I found out when I did a small claims court case in Tuscaloosa county.

    NAL but my child was adopted by my husband. In order to do that the bio dad has to sign his rights over. Therefore you're not next of kin anymore. Unless it's in the will that he was leaving you anything, you should get a lawyer, if it's in the will you should be fine.

    The question comes down to why the police aren’t pursuing charges against him.
    I’m going to ask you some questions that can help others who read this but it’s also to find something out. I’m asking about his behavior, and his boundaries. i.e. is his harassment constant or not.
    Was he alone or were others watching when he said that he’d kill? Is that his house, or a place where others live as well?
    Is it HIS property or is he living with others who own it, and or frequenting. Does this happen when others are able to see him acting up or when no one else is around. This would tell me if he wants to be seen by others. That might reveal a link between his forgiven record and his boldness to threaten.
    How long has he lived there? Has this been constant since you moved in? How close to your house is his place.
