I was told by my sister that my dad’s widow gets the money for a house even though her name isn’t on any papers The house is in Indiana & she lives in Florida My sister said according to Florida law my dad’s widow gets everything including money for the house in Indiana The house in Indiana isn’t paid off My sister said the Indiana house is being foreclosed & my dad’s widow gets that money …… This doesn’t make sense to me & doesn’t seem right The lawyer she has been contacted by says we’re getting bankruptcy money then tells her something else then tells her that we’re not getting anything & my dad’s widow is getting it all ….. The lawyer keeps changing what he says after adding new stuff is how it seems to me going by what my sister has said …… I don’t know about law stuff but when my sister 1st started msging me with this stuff something didn’t seem right to me & I questioned this from the start ….. Can anyone shed any light on this ?

be very careful these people are actually lawyers. Get their full names, the firms they work for and who they are representing then confirm they are barred attorneys on your state bar site. Deaths, home sales, weddings, etc. are public record and scammers will sometimes use these as lists of potential victims. She shouldn’t give out any non-public information to them like SS numbers, bank accounts, etc.
we have a problem with lawyers in probate court assisting real estate investors in stealing homes from people. If your home is in pre foreclosure or foreclosure and let’s say you owe the bank 100k… the bank will let houses go to short sale for the balance on the principal only… that means they subtract the interest and then you owe around 50k.
I would find out for sure if there is a will, if he did have one definitely have it probated, also something doesn’t sound right about what the sister is saying,me personally would contact my own lawyer and see what can be done, I do know that as his wife she more than likely is going to get alot of it but in some states if it’s property that had anything to do with your mom’s family you may can keep her from getting that
Please look up probate laws and then ask additional questions. There are so many factors that come into play based on what information is posted.
this lawyer is probably you dads wife’s lawyer do NOT speak to him he isn’t looking out for you, he was hired by your dads spouse and works for her, you need your own lawyer
I think you’re right to be suspicious. It does seem like something may not be on the up and up. Especially if the story keeps flip flopping
a lawyer contacted her She never gave them her cell phone number She said they have ways to get your cell phone number but have to pay for it This didn’t seem right to me from the start The lawyer changes what he says It seems fishy to me
I would suggest she call and try to hire someone to explain it to her. Laws vary state to state and when probate gets involved it gets so complicated. I would suggest an attorney that’s knowledgeable about real estate and probate. A lot of attorneys cover more than one specialty. I’m sorry! This can all be so confusing but it sounds like your sister needs to be protected and represented properly.
what lawyers did you speak to? Lawyers that are already involved? Do they represent someone else in the situation?

I don’t think you would get proceeds from a foreclosure. The money would go to the bank I believe.
