Hi! I got married a year ago. I’m Canadian. He’s American. I just got my permanent residency on my own as I’m an Indian Canadian(tribal) HAVENT been able to work for a year as I didn’t have my green card. I gave my husband(soon ex) 21 thousand American that was Canadian currency, which I acquired before our marriage, because one he told me I need to give him collateral to prove that I didn’t marry him for a green card, which doesn’t make sense cause I got it on my own and now I’m going back to Canada.. Now he’s trying to say that he won’t have to give me that back as he’s supported me for a year and paid everything. Is that true, we’re in California! Looking for some in sight on this

You can still recover those Canadian currency.
If you gave it to him as a gift then its a gift. Doesn’t sound like it was a loan. No contract for repayment I am assuming. Everything is expensive in California so if he paid all the bills, food, insurance etc for both you and him, I am sure he is out a lot more than double what you gave him.
NAL you literally paid him to get married to get ur green card…you didnt get it on ur own getting married set you up for the green card process…thats how it works…my bf and i were approached 100’s of time when we lived somewhere that had an exorbitant of hungarians on work visas with a allowance monthly for the marriage paid to us and then a large cash sum upon permanant green card status. And had to be married a certain amount of years and had to go to ins interviews and live together…which this is illegal…so we passed but it happens all the time.
So if he told ya the collateral thing he lied to you and actually screwed you and prejudiced himself…because it looks like he got paid to marry you in exchange for a green card.

Sounds like you gave him a dowry. That money is no longer yours.
Your green card came from INA 289 if I’m understanding you correctly, and not from the marriage. If that’s the case I’m not sure why your husband asked for that money unless the intent was just to keep it. If you’re going through a divorce in the US, you can bring up the gift of separate property to see if you are able to get anything back. It may be difficult if he was solely paying (although you giving him money negates that…).
I don’t practice in CA so I’m not sure what the alimony laws would be. Consult with a local family attorney who is familiar with USCIS rules.
