I would sell the house and pay off the mortgage then give your husband the 1/4 he’s entitled to and then you can take your 3/4 and cash out a cheaper house without a mortgage.

Many years ago I lived in New York I was divorced from my ex-husband but he did pay child support and he did have visitation although we had to meet at a police station. Because of his history of domestic violence and drug use I was able to determine whether or not I would leave the kids with him if he appeared intoxicated. I finished college and got a job in Florida, and went to court and told the judge that I could not afford to live in New York and raise my kids. Same situation just kind of backwards, because my new job was paying me so well and I was able to buy a home in Florida the judge allowed me to leave. I guess every case is different but also this was quite some time ago… but he did try to stop me, he did have visitation, and he did pay child support which the judge ordered that he continued to pay after I moved. I was able to prove to the court that I could give them a better life outside of New York in Florida near my mother with my new job and a house. I don’t know if that helps at all but it reminded me of my own situation. Only reversed BUT***IF***I HAD MOVED TO FLORIDA WITHOUT GOING TO COURT I KNOW I WOULD HAVE GOTTEN IN TROUBLE. DO IT THE RIGHT WAY TELL THE JUDGE WHAT I DID THAT YOU CAN GIVE HER A BETTER LIFE UP NORTH WITH HELP HOUSING AND BETTER JOBS. I wish you all the best I don’t know why a judge would prevent stop you from providing your children with a better life especially if she has never even met their father. You are her primary caregiver at 13 years old she is only 5 years away from adulthood. Please go to court and do it the right way that way you will not wake up one day to a nightmare and police all over the place.

If you are unable to afford that process, you usually need Dads permission for the name change, if though there is no court documents…hes been established as the father on BC and thru the medicaid system…so he is legally tied to her. Does he pay any support? When was the last time you spoke to him? Every state has diff laws and procudures…so youll want to consult a local custody atty or even legal aid may be able to amswer just some of the simpler questions about the abandonement laws and whats required. 4k probaly is because the lawyer was going to try and do the terminate rights via volunteering, and process ur husband to adopt and replace bio dad on BC…but its hard to tell…lawyers cost alot and when its more complicated like this, absent dad, new spouse, no court orders…it does take alot of work. See if legal aid, can clarify whats steps to take if abandonment is an option and if not what forms/steps to take to terminate his rights if he would and start an adoption from ur husband etc

So it can’t be just a friend who does repairs.
Or you can start with the HOA and play them. Tell them to provide you with the invoice. Which they will. Then ask them who the contractor is as you’d like to work with them directly and pay for the repair and not the HOA to make a profit. Do all this in emails letters by the way. (don’t mention the profit part)
THEN, after they give you this, ask them to state the other contractors / vendors they got bids from.
Keep in mind the HOA has an obligation to get 3 bids and pick the best one.
This gives you a chance to see if 1) they’re on the level. 2) they’ve given a complete and honest description to the vendors 3) if they vendors even came out and bid by sight or description.
So here’s what happens with bids. You’ll get someone bidding saying “well, if the paint is chipped, then the whole fence needs painted to match, so we’ll do that too”, etc. These vendors are looking for a way to take additional money that’s not needed.
Legally the HOA can play this game, but if you can prove they only got one bid and didn’t get two others (even if it’s their right to skip that) it can hold additional weight in a small claims case. Especially if you got a few bids from some other vendors. and you can show this photograph.
I’m sure most vendors are thinking the metal may need bent back into position, etc.
Lastly, you want to call their vendors and talk them down. take the pic to them and give them an honest account. This means the HOA gets an even lower bid. Contractors know HOA’s are made of money and bid high.
